The Vulnerable Witnesses Act 2019 – Scotland
One of the great contributions of forensic psychology is highlighting the needs of vulnerable witnesses within criminal investigations and courts. In May 2019 Scottish MPs unanimously passed a milestone legislation allowing child witnesses to pre-record evidence ahead of trials. Using the Scandinavian Barnahus system children will ideally undertake one forensic interview in a child friendly environment with linked support to ensure they are not retraumatised and any linked trauma and health requirements are met.

In keeping with this system our aim when completing capacity assessments with young people and adults is to provide considered advice to Legal Representation, Family and Courts on how best to communicate with that person through understanding and responding to their needs.
